Our Will and Probate Department deals with the following matters:
3. Inheritance (Provision for Family and Dependants) Act 1975 Claims
This Act allows family members and dependants of a deceased person to make a claim from the deceaseds estate when they consider that either they should have been left money by the deceased but have not been or that the provision for them in the deceaseds will is not adequate.
We can act for the executors or administrators in defending such claims or alternatively for family and dependants wishing to make a claim. A claim under the Act must be made within 6 months of the date of the grant of probate or letters of administration although the Court does have power to extend this time limit in certain circumstances.
